1. CONTEST DESCRIPTION:

The Namely HR Scholarship Contest (the “Contest”) begins on Thursday, June 7, 2018 at 12:01 a.m. Eastern Daylight Time (“EDT”) and ends on Friday, August 17, 2018 at 11:59:59 p.m. EDT (the “Contest Period”). There will be one (1) Grand Prize winner and four (4) Runner-Up prize winners. All eligible entries will be judged by the Sponsor and Sponsor designated HR professionals (the "Judges") based on equally weighted judging criteria as later defined in these rules. Entry in this Contest does not constitute entry into any other contest, promotion or sweepstakes. By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Namely, Inc., 195 Broadway, Floor 15, New York, NY 10007 (the “Sponsor”) and COHEN-FRIEDBERG ASSOCIATES, LLC Framingham, MA 01702 (the “Administrator”), whose decisions shall be final and legally binding in all respects and not subject to any further review. 

2. ELIGIBILITY:

This Contest is open to legal U.S. residents (excluding residents of Puerto Rico, U.S. Virgin Islands, Guam and other United States territories), who work in the HR field, (in an HR department, a recruiter or a recruitment agency), who are twenty-one (21) years of age or older at the time of entry (“Entrant”). Employees, officers, and directors of Sponsor, Administrator, Contest prize suppliers, and each of their affiliated companies, subsidiaries, licensees, franchisees, distributors, dealers, sales representatives, their advertising and contest agencies, and any and all other companies associated with the Contest (collectively, the “Contest Entities”), and each of their immediate family members and/or people living in the same household are not eligible to enter or win. All eligibility is subject to all federal, state, and local laws and regulations. All entries submitted are the property of the Sponsor.

3. HOW TO ENTER THE CONTEST:

During the Contest Period, enter the Contest through the Sponsor’s Contest site at scholarship@name.com .  Complete all the required information on the registration page including answering the below Contest question. Complete your entry by agreeing to the Official Rules and clicking on the button to submit.  You may enter utilizing any format you so choose (i.e. Word Doc, PDF, Video, Comic Strip, Photo, etc.)

Contest Question: How will the Namely HR Scholarship help you build a better workplace? In your response, describe at least one near term Challenge you hope to solve in your current workplace, and share how you hope to change the field of HR over the course of your career.

Limit: One (1) entry per person only during the Contest Period. Limit: One (1) prize per person or household.

All entries are subject to verification and approval by the Sponsor. Entries that do not meet the requirements for entry or otherwise do not comply with the Official Rules herein may be disqualified. Any attempted form of entry other than as described herein is void. Sponsor will determine in its sole discretion, what constitutes a valid entry. All materials submitted become the property of the Sponsor and will not be returned or acknowledged. 

Sponsor reserves the right to cancel or modify the Contest if fraud or technical failures destroy the integrity of the Contest as determined by the Sponsor, in its sole discretion, and to award the prizes based on eligible entries received prior to the cancellation. 

 

Requirements for any photo, video or essay:

  • Entry must not infringe upon the rights, including, but not limited to, copyrights, trademarks, right of publicity, right of privacy or other intellectual property or other rights, of any person or entity other than those owned by the entrant.  Entry must not contain identifiable commercial product brands, or any trademarks, company names or logos of any of Sponsor's competitors. 
  • Entry must be original, unpublished, the sole property of entrant, and not previously submitted in any other contest.  An "original" is a product of one's own mind and is not a copy or imitation of another individual's or entity's work.
  • Entry must not include unsuitable content or depict or incorporate: unsafe behavior or situations; obscenity; disparagement of any product or person or company; or other offensive conduct or material, or otherwise include inappropriate content as determined in Sponsor's sole discretion.
  • You must have permission from any identifiable person who appears in or otherwise contributed to the Entry (“Participant”) to permit the use and exhibition of the Entry by Sponsor in the manner set forth in these Official Rules, including, without limitation, permission to use a company name, person's name and or likeness. Participants must assign all rights to the Entry for usage to Sponsor.

Entry Notes:  Once an entry has been submitted, Entrant cannot access/revise entry in any way.  No photo, video, essay, title or description may be obscene, pornographic, violent, cruel, mean spirited, offensive in any manner, or in any other way not suitable to be published. If an entry falls into this category (at the Administrator's or Sponsor’s or Judges sole discretion), their corresponding entry will become void. Tampering with the entry process or the operation of the Contest is prohibited and any entries deemed by Sponsor, in its sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.

Entries made by any other individual or any entity, including but not limited to commercial sweepstakes/contest subscription notification and/or entering services, will be declared invalid and disqualified for this Contest. The Sponsor’s designated computer will be the official timekeeper for all matters related to this Contest. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant.  “Authorized account holder” is defined as the person who is assigned to an email address by an Internet Access Provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.  

4. JUDGING CRITERIA:

Each eligible Entry will be judged based on the following equally weighted criteria:

  • How well did the Entrant define the challenge(s) they face? Did they provide anecdotes, research, data, etc., to bring the problem to life?
  • What level of impact will the Entrant have in their current workplace?
  • What level of impact will the Entrant have on the field of HR?
  • How unique is the Entrant’s vision of their career?
  • How well did the Judges get to know the Entrant through their Entry?

5. CONTEST PRIZES:

One (1) Grand Prize: At the end of the Judging period the Entry with the highest Judges score will win the following.

  • Strategic Human Resources Leading eCourse from Cornell University.
  • SHRM One Year Membership + Application Fee
  • Free Ticket, travel and accommodations for HR Redefined 2019 as well as speaking opportunity at the conference.

Prize includes the following: Two (2) night’s hotel accommodations in New York City May 9th-10th, 2019. Roundtrip air transportation for one (1) to the prize destination city. If the winner’s home address is within 175 miles of the New York City, ground transportation will substitute for air transportation as determined by Sponsor at its sole discretion. Travel must be round trip. If flights are required, Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground, transportation, meals, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of the winner. Travel restrictions, conditions, and limitations may apply. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates.  Actual value may vary based on airfare fluctuations and distance between departure and destination.

Winner will not receive difference between actual and approximate retail value.  Prizes are non-transferable, non-refundable, and no substitutions will be made except as provided herein, in the Sponsor’s sole discretion. Prize is not redeemable for cash.   Sponsor reserves the right to substitute a particular prize for one of comparable or greater value. Winner is responsible for any and all applicable local, state, and/or federal taxes and fees.

Trip winner must have valid travel documents (e.g., government issued I.D., passport, etc.) along with any other travel requirements in order to travel by plane prior to departure, and failure to do so may result in forfeiture of Prize.  Winner is solely responsible for satisfying all legally required conditions of travel. Winner must have a valid major credit card to check-in to a hotel. 

  • 1.1 mentoring session with an HR expert in the Namely community in the subject matter of winner’s choice. HR expert to be determined by Sponsor at its sole discretion. Date and time of session to be mutually agreed upon.

Approximate retail value of this prize package is $8,000.

 

Four (4) Runner-Up Prizes: Each winner to receive the following:

  • Data Analysis Circuit-eCourse with General Assembly.
  • SHRM One Year Membership plus Application Fee.

Approximate retail value of each prize $2,000. Terms and conditions of each prize element apply. Offer expires one (1) year from issuance date.  

Prize will be awarded only if the potential prize winner fully complies with these Official       Rules. Contest Prizes are non-assignable and non-transferable and has no cash     value. Sponsor reserves the right in its sole discretion to substitute prize(s) of comparable value if any prize listed is unavailable, in whole or in part, for any reason. Winner is responsible for any and all applicable local, state, and/or federal taxes and fees.

6. CONTEST WINNER SELECTION DATES AND NOTIFICATION:           

Prize winners will be announced on or about September 17, 2018. Conduct of the Contest is under the supervision of the Sponsor. Potential prize winners will be notified in person and/or by phone and/or by email or mail or express mail, whichever is deemed appropriate by the Sponsor, using the contact information provided at the time of entry. Sponsor shall have no liability for any potential prize winning notification that is lost, intercepted or not received by any          potential winner for any reason. If, despite reasonable efforts, any potential prize winner does not respond within (4) calendar days of the first notification attempt, or if the prize notification is returned as unclaimed or undeliverable such prize winner will forfeit his or her prize and an alternate winner (defined as the next entry with the greatest number of Judges points) may be selected. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected.

The winner is subject to verification. Each potential Contest winner will also be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release and W-9 tax payer request for identification, within (4) calendar days of attempted notification. If a potential winner fails to respond to any notification attempt within four (4) calendar, or if any attempted notification or prize delivery is returned as undeliverable, or if a potential winner fails to complete and return any required affidavit or release within the specified time period, the potential winner may be disqualified and an alternate winner may be selected as determined by the Judges in their sole discretion.

Once eligibility has been verified and the Administrator receives the prize winner’s requested information, the Sponsor will arrange to award the prize. Prize winner must reply with all required information in order to receive their prize.

7. GENERAL PRIZE RESTRICTIONS/CONDITIONS:

By entering THE CONTEST, each entrant agreeS for entrant and for entrant’s heirs, executors, and administrators (A) to release and hold harmless Contest Entities, prize suppliers and their respective affiliates, parents, owners, franchisees, officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Contest and/or his/her/their acceptance, possession, use, or misuse of any prize or any portion thereof; (B) that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose; and (C) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Contest itself, and to be bound by all decisions of the Sponsor, which are binding and final. Failure to comply with these conditions may result in disqualification from the Contest at Sponsor’s sole discretion. 

8. CONDITIONS OF PARTICIPATION:

By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, Judges and Administrator, all of whose decisions shall be final and legally binding in all respects.

Entrant agrees that by submitting an Entry: entrant relinquishes and irrevocably assigns, conveys and otherwise transfers any and all right, title and interest to the Entry, including any and all copyrights, trademarks, contract and licensing rights and other intellectual property and proprietary rights in the Entry; the Entry and its content becomes the sole and exclusive property of Sponsor; all rights of ownership and publication of same will become the sole and exclusive property of Sponsor; and entrant agrees to allow use of his or her Entry, entry materials, name, photograph, likeness, voice, biographical information, statements and complete address (collectively, the "Attributes"), for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation or authorization, (except where prohibited by law), and agrees to execute and deliver any documents necessary to vest in Sponsor the rights and waivers provided in these Official Rules, without review, approval or notice or additional compensation, except where prohibited by law.  Additionally, entrant agrees that Sponsor may publish or post such Attributes on Sponsor's website, the Contest Application or any other website(s) or web page(s) owned or operated by Sponsor.  By entering, all participants and/or entrants release and hold harmless Sponsor, Judges, Administrator and the Contest Entities from all claims arising out of the use of such Attributes.

By submitting an Entry, entrant agrees that Sponsor and its agents have the unrestricted right to: right to record, copy, publish, use, edit, exhibit, distribute, perform, merchandise, license, sublicense, adapt and/or modify the Entry in any way, in whole or in part, commercially or non-commercially, in any and all media, without limitation including the right to publish and display the Entry for advertising and publicity and to edit and make derivative works from the Entry, all and without any notice, review or compensation to entrant or third parties. 

9. ADDITIONAL TERMS:

Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding prizes or continuing with the Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date, Sponsor will (if possible) Judge all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such Judging shall be each Entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prizes described in these Official Rules will be awarded.  If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

10. LIMITATION OF LIABILITY:

The Released Parties (defined in paragraph 7 above) are not responsible for, and entrant hereby releases the Released Parties from any claims arising from: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the            unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Contest; (iv) electronic or human error which may occur in the administration of the Contest or the processing of entries; (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest and (vi) use of any prize.

11. DISPUTES:

Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class     action, and exclusively by the state of New York, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3 unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.       

12. WINNERS LIST:

To obtain the name of the Contest winners, send a self-addressed stamped envelope to: Namely, “Namely Scholarship Winners”, 195 Broadway, Floor #15, New York, NY 10007.  All such requests must be received by 8/31/18.
